Water law
Water law is of essential importance for many industrial enterprises. Water is a cooling medium or production means or is used for cleaning. Enterprises are therefore obliged to ensure the lawful nature of the work flows including water procurement, water use and waste water purification and disposal. This is of fundamental importance for many enterprises.
We advise you on all issues relating to water law. This includes the procedures for obtaining permits and approval for water procurement, whether by groundwater pumping or water withdrawal from surface water or waste water disposal. Moreover, we assist your company in all contract law issues if you cooperate with third parties.
Water supply and waste water disposal are a considerable cost factor for companies. For example, many German Länder demand water withdrawal fees in the context of water procurement. Anyone intending to dispose of waste water is obliged to pay fees for the discharge. Fees are also incurred for the discharge of waste water into the public sewerage system.
In addition, fees have to be paid under private law – for instance in the case of industrial parks for the fresh water supply and the discharge of waste water into a private waste water plant. However, the law opens up numerous options to reduce water procurement and waste water fees.
Apart from that, water law aspects also reach into legal relationships governed by private law, e.g. as regards contracts for water supply, water treatment and waste water disposal.
We advise you on these issues. Together we will find ways to draft legally secure contracts.
